In the course of providing you or being involved in the business of title and settlement services, we will obtain certain information from and about you which, we understand, you would prefer to keep confidential. We respect that preference and want to give you the following assurances.
Kinds of Information We Will Collect From You:
Personal Information that identifies you.
This information may include, among other things, your name, address, social security number.
This information may include, among other things, any other information pertaining to our title and settlement services involving you.
This information may include, among other things, lawsuits in which you are or have been involved and the outcomes, if any have occurred, of those lawsuits. Prior bankruptcy actions, if any, may require certain information to be provided.
Types of Information We Will Collect About You From Others:
Property Title Information.
We may obtain title and lien searches and copies of legal documents in the public records of your county.
We may obtain real property tax transcripts from governments agencies.
Security of Your Confidential Information.
We maintain this information in two forms –in paper files and in electronic files. All active paper files are maintained within our various facilities in such a manner that individuals who have no need to access that information will not be able to obtain it. All electronic data is maintained on a password secured, limited-access network. All employees receive training in and must acknowledge the obligation to respect your privacy rights. After a transaction is completed, the file, whether paper or electronic, is archived and may not be accessed by unauthorized personnel or third parties.
Disclosure of Your Confidential Information.
We do not share your confidential information with any affiliated company or third party except as is necessary to provide the title and settlement services we are retained for.
Once the title and settlement services has been provided, and your confidential information has been archived, we make no further use of it except for a possible written communication directly from our company to you. We do not sell or otherwise provide it to third parties for any purpose. We may contact you again to remind you of our title or settlement services.
We are allowed to share your information without your permission in a limited number of situations. Individuals or entities providing services to us may view your information. For example, our accountants or underwriter auditors may review files to audit our books and records. We may (and sometimes must) provide information to governmental entities, for example, in order to record deeds and mortgages, provide state and federal tax information or respond to court orders. We also may share some information with your mortgage broker, lending institution, or realtor, if applicable, as part of the settlement transaction.
